1. 合約與適用範圍

本終端使用者授權合約（「EULA」）由你與 Bridge AI Works（Google Play 商品頁列示的發行者，以下稱「我們」）訂立，規範你安裝、存取或使用 ExamCreator Android 應用程式及其更新（合稱「軟體」）。安裝、下載或使用軟體，即表示你同意本 EULA；若不同意，請勿安裝或使用。

2. 授權

在你遵守本 EULA 的前提下，我們授予你一項可撤回、非專屬、不可轉讓、不可再授權且僅供個人或內部合法教育用途的有限授權，讓你在自己控制的相容 Android 裝置上使用軟體。

本授權不是軟體的出售。除本 EULA 明確授予的權利外，我們保留所有權利、所有權及利益。

3. 使用限制

除非強制適用法律另有規定，你不得：

• 複製、散布、出租、出售、轉售、公開展示或以其他方式提供軟體給第三人；
• 反向工程、反編譯、反組譯、修改或製作衍生作品；
• 移除、遮蔽或變更著作權、商標或其他權利標示；
• 規避安全、付費、使用量、帳號或其他技術限制；
• 以違法、侵權、欺騙、騷擾、破壞學術誠信或會損害他人權利的方式使用軟體。

軟體包含的開源元件及其授權列於 App 內「更多 → 法律與授權」。若個別開源授權就該元件授予較大權利，該授權優先適用；不得移除或遮蔽該授權與通知畫面。

4. 內容、AI 輸出與教育用途

你對輸入軟體的題目、教材、提示詞、答案、檔案及其他內容負責，並保證你擁有或已取得必要權利。不得使用未授權的受保護內容，或要求軟體產生違法、侵權、具欺騙性或不當內容。

軟體可能協助產生題目、說明或其他 AI 輔助內容。此類內容可能不完整、不準確或不適合特定對象；你必須在使用、發佈或評量前自行審查與驗證。軟體不保證學習成果、考試成績、內容原創性或任何教育、專業或法律結果。

5. 隱私與資料

ExamCreator 的資料處理以其 隱私權政策 為準。本 EULA 不授權我們進行超出該隱私權政策所述範圍的資料處理。若你自行啟用或設定第三方服務、AI 供應商或外部帳號，該服務的條款與隱私政策也可能適用，且你須自行確認其適切性。

如你需要支援並主動聯絡我們，請避免傳送不必要的個人資料、學生資料、機密教材或敏感資訊。

6. 智慧財產

軟體、介面、設計、名稱、標誌、程式碼與其他由我們提供的材料受智慧財產權保護。你保留自己依法擁有的內容權利；我們不主張取得你內容的所有權。

7. 第三方服務與 Google Play

Google Play 依其自身條款提供下載、帳戶或交易相關服務。本 EULA 不決定或限制 Google 對你的任何責任、權利或救濟；你使用 Google Play 及任何第三方服務時，亦須遵守其各自條款。就軟體本身的支援、維護或保固而言，我們依本 EULA、我們明示提供的支援內容及不可排除的法律義務負責。若 Google Play 的強制條款與本 EULA 衝突，以該等強制條款為準。詳見 Google Play 與 Android 補充條款。

8. 付款與訂閱

軟體可免費安裝，並包含五份考卷的免費匯出額度。免費方案同時亦限制可同時存在的考卷數量，刪除考卷即可釋出名額。有效訂閱會同時解除這兩項限制。免費額度用完後，繼續匯出考卷需要有效訂閱。現有訂閱為自動續訂的月費方案 com.bridgeaiworks.examcreator.pro.month 與年費方案 com.bridgeaiworks.examcreator.pro.year。價格、幣別、計費週期與適用優惠以你購買前 Google Play 顯示的當地店面資訊為準，且可能因國家或地區而異。

Google Play 處理付款、續訂、取消、退款與訂閱管理。你可在 Google Play 帳戶設定取消訂閱；取消會停止下一次續訂，訂閱通常持續至已付款期間結束。退款及其他消費者權利依 Google Play 條款與適用法律處理。若 Google Play 實際提供免費試用或介紹優惠，試用期間、試用後價格與續訂資訊會在購買流程中明示。

8A. AI 供應商費用

訂閱解除軟體本身的匯出限制與同時保存考卷份數的限制，但不包含 AI 供應商的使用額度。你自行選擇的 AI 供應商可能依其條款、用量與價格向你收費；請在發出請求前確認該供應商的費用與設定。使用真正本機的模型或端點不會產生該第三方供應商費用。你的 API 金鑰儲存在裝置的安全儲存空間，但任何能解鎖並使用你的裝置的人可能可以使用已設定的金鑰，因此請妥善保護裝置。

9. 更新、可用性與終止

我們可能提供修正、更新或功能變更，亦可能要求你安裝更新才能繼續使用部分功能。我們不保證軟體永遠可用、無錯誤或與所有裝置相容。

若你違反本 EULA，授權將自動終止；我們亦可在法律允許範圍內暫停或終止授權。終止後，你必須停止使用並刪除軟體。

9A. 本機資料與備份

題庫、考卷、草稿，以及你匯入的來源文件與影像等本機 ExamCreator 資料，主要儲存在你的裝置上；Bridge AI Works 不保留副本，也無法替你還原。Android 版本會將這些本機資料標示為可使用 Android 裝置備份，該備份由你的 Google 帳號與裝置設定控制。Bridge AI Works 不營運、不存取，也不保證該備份或還原程序。API 金鑰與免費匯出額度不會納入 Android 備份。清除資料、解除安裝或遺失裝置可能導致本機作品遺失；請定期匯出重要內容。

10. 免責與責任限制

在法律允許的最大範圍內，軟體按「現況」及「可用狀態」提供，不附任何明示、默示或法定保證，包括適售性、特定目的適用性、不中斷、安全性、正確性與不侵權的保證。

在法律允許的最大範圍內，我們不對間接、附帶、特別、懲罰性或結果性損失，以及資料遺失、營收損失、商譽損失或考試／教育結果負責。本條不限制法律不得排除或限制的責任。

11. 適用法律、變更與聯絡

本 EULA 不排除任何不可放棄的消費者保護權利。在適用法律允許的範圍內，本 EULA 以中華民國（臺灣）法律為準，但不適用其法律衝突原則。我們可能因法律、產品或安全因素更新本 EULA，並會更新本頁日期；如法律要求，將就重大變更提供額外通知。僅在適用法律允許時，於更新條款生效後繼續使用軟體，表示你接受更新後版本。

1. Agreement and scope

This End User License Agreement ("EULA") is between you and Bridge AI Works, the publisher identified on the applicable Google Play listing ("we," "us," or "our"). It governs your installation, access to, or use of the ExamCreator Android application and its updates (collectively, the "Software"). By downloading, installing, or using the Software, you accept this EULA. If you do not accept it, do not use the Software.

2. License

Subject to your compliance with this EULA, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Software on Android devices you control, solely for personal or internal lawful educational purposes.

This license is not a sale of the Software. We retain all rights, title, and interest not expressly granted in this EULA.

3. Restrictions

Except where mandatory law permits otherwise, you may not:

• copy, distribute, rent, lease, sell, resell, publicly display, or otherwise make the Software available to others;
• reverse engineer, decompile, disassemble, modify, or create derivative works of the Software;
• remove, obscure, or alter copyright, trademark, or other proprietary notices;
• circumvent security, payment, usage, account, or other technical restrictions; or
• use the Software unlawfully, infringe rights, deceive, harass, undermine academic integrity, or otherwise harm others.

Open-source components and their notices are listed in the app at More → Licenses. Where an individual open-source license grants greater rights for that component, that license controls. You may not remove or obscure those notices or that screen.

4. Content, AI output, and educational use

You are responsible for questions, course materials, prompts, answers, files, and other content you submit to the Software. You represent that you own or have obtained the rights needed to use that content. Do not submit unauthorized protected material or seek unlawful, infringing, deceptive, or inappropriate output.

The Software may help generate questions, explanations, or other AI-assisted content. Such content can be incomplete, inaccurate, or unsuitable for a particular audience. You must review and verify it before use, publication, or assessment. The Software does not guarantee learning outcomes, examination results, originality, or any educational, professional, or legal result.

5. Privacy and data

ExamCreator's data practices are governed by its Privacy Policy. This EULA does not authorize data practices beyond that policy. If you choose to enable or configure a third-party service, AI provider, or external account, that provider's terms and privacy policy may also apply, and you are responsible for evaluating them.

If you contact support voluntarily, please do not send unnecessary personal information, student information, confidential course materials, or sensitive information.

6. Intellectual property

The Software, its interface, design, names, logos, code, and other materials we provide are protected by intellectual property laws. You retain rights you lawfully hold in your own content; we do not claim ownership of that content.

7. Third-party services and Google Play

Google Play provides download, account, or transaction-related services under its own terms. This EULA does not determine or limit any responsibility, right, or remedy that Google may have in relation to you. Your use of Google Play and third-party services is also subject to their respective terms. For the Software itself, we are responsible for support, maintenance, or warranty only as set out in this EULA, support we expressly provide, and non-waivable legal obligations. If mandatory Google Play terms conflict with this EULA, those mandatory terms control. See the Google Play & Android Supplemental Terms.

8. Payments and subscriptions

The Software is free to install and includes a free allowance for five paper exports. The free plan also limits how many papers may exist at the same time; deleting a paper frees a slot. An active subscription removes both limits. After the export allowance is used, further paper exports require an active subscription. The current subscriptions are the auto-renewing monthly plan com.bridgeaiworks.examcreator.pro.month and yearly plan com.bridgeaiworks.examcreator.pro.year. The price, currency, billing period, and any applicable offer are those shown in your local Google Play storefront before purchase and may vary by country or region.

Google Play handles payment, renewal, cancellation, refunds, and subscription management. You can cancel through your Google Play account settings; cancellation stops the next renewal and the subscription ordinarily remains available through the end of the paid period. Refunds and other consumer rights are governed by Google Play terms and applicable law. If Google Play actually offers a free trial or introductory offer, its duration, post-offer price, and renewal information will be shown in the purchase flow.

8A. AI provider charges

A subscription removes the Software's own limits on exporting and on how many papers you may keep at once. It does not include AI-provider usage. Your chosen AI provider may charge you under its own terms, usage rules, and pricing, so review those charges and settings before making a request. A genuinely local model or endpoint does not create those third-party provider charges. Your API key is stored in device secure storage, but a person who can unlock and use your device may be able to use a configured key, so protect your device.

9. Updates, availability, and termination

We may provide fixes, updates, or feature changes and may require an update for continued use of some features. We do not guarantee that the Software will always be available, error-free, or compatible with every device.

Your license ends automatically if you breach this EULA. We may suspend or terminate the license where permitted by law. On termination, you must stop using and delete the Software.

9A. Local data and backup

Your local ExamCreator data, including question banks, exams, drafts, and imported source documents and images, is primarily stored on your device. Bridge AI Works keeps no copy and cannot restore it for you. The Android build marks that local data as eligible for Android device backup, which is controlled by your Google account and device settings. Bridge AI Works does not operate, access, or guarantee that backup or restoration process. API keys and the free export counter are excluded from Android backup. Clearing data, uninstalling, or losing a device can cause local work to be lost; export important work regularly.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Software is provided "as is" and "as available," without express, implied, or statutory warranties, including warranties of merchantability, fitness for a particular purpose, uninterrupted operation, security, accuracy, and non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of data, revenue, goodwill, or examination or educational outcomes. Nothing in this section limits liability that cannot lawfully be excluded or limited.

11. Law, changes, and contact

This EULA does not exclude non-waivable consumer rights. To the extent permitted by applicable law, it is governed by the laws of Taiwan (R.O.C.), excluding conflict-of-law rules. We may update this EULA for legal, product, or security reasons and will update the date on this page. Where law requires, we will give additional notice of material changes. Only where permitted by applicable law, your continued use of the Software after updated terms take effect means you accept the updated version.
